Section G: lowest rent paid

Definition

The notice to a new tenant, in section G of the lease, stating the lowest rent paid for the dwelling in the 12 months before the lease begins (art. 1896 C.C.Q.).

What you must declare

When signing a lease, the landlord gives the new tenant a notice stating the lowest rent paid in the 12 months before the lease begins, or the rent fixed by the Tribunal administratif du logement (TAL) during that period (art. 1896, Civil Code of Québec). Since the 2026 form, section G covers three cases:

  • the lowest rent in the last 12 months;
  • no rent paid in the last 12 months: you enter the last rent paid and its date;
  • a former private seniors' residence unit converted into an ordinary dwelling.

No notice is due when section F applies, or for low-rental housing.

The new tenant's remedy

A new tenant who pays more than the declared rent can ask the TAL for rent fixing within 10 days of signing the lease. If no notice was given, they have 2 months from the start of the lease; if the notice contains a false statement, 2 months from discovering it (art. 1950 C.C.Q.).

Since Bill 31, for a lease signed on or after February 21, 2024, a false statement or knowingly leaving out the notice exposes the landlord to punitive damages. Keep proof of the rents paid in the year before each new lease.
